1. Agreement
By using StrataView, you agree to these terms. These terms form a binding agreement between you (or your organisation) and StrataView Pty Ltd (ABN 00 000 000 000). If you are using StrataView on behalf of a strata scheme or organisation, you represent that you have authority to bind that entity.
2. The service
StrataView provides a strata management platform including maintenance tracking, motion management, correspondence, document storage, caretaker task management and AI-assisted features (Ask StrataView). Features available depend on your subscription tier.
3. Accounts and access
You are responsible for maintaining the security of your account and for all activity that occurs under it. You must not share account credentials or allow unauthorised access. You must notify us immediately at support@strataview.com.au if you suspect a security breach.
4. Subscriptions and billing
Paid subscriptions are billed quarterly by invoice. Pricing is per lot per month. You may cancel at any time; you retain access until the end of your current billing period. No refunds are issued for partial periods. The Essential tier is free and has no billing.
5. Your content
You retain ownership of all content you upload to StrataView (by-laws, minutes, documents, maintenance records). You grant StrataView a limited licence to store, process and display your content solely to provide the service. We do not use your content to train AI models for other customers.
6. Ask StrataView AI
Ask StrataView is an AI information tool grounded in legislation and your scheme's documents. It is not legal advice. Answers should be verified by a qualified strata lawyer before being relied upon for formal legal purposes, disputes or proceedings. StrataView is not liable for decisions made based on AI-generated responses.
7. Acceptable use
You must not use StrataView to violate any law, infringe intellectual property rights, harass or harm others, or attempt to gain unauthorised access to any system. We reserve the right to suspend accounts that violate these terms.
8. Service availability
We aim for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be notified in advance where possible. We are not liable for losses arising from service downtime except to the extent required by Australian consumer law.
9. Limitation of liability
To the maximum extent permitted by law, StrataView's liability for any claim is limited to the amount you paid in the 12 months preceding the claim. We are not liable for indirect, consequential or incidental damages. Nothing in these terms limits liability that cannot be excluded under the Australian Consumer Law.
10. Governing law
These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
11. Changes
We may update these terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of StrataView after that date constitutes acceptance of the updated terms.
